What is the difference between policy and law is that a policy is a principle that guides decision making, while a law is a rule enforced by an institution. Laws and policies serve different purposes, and both are used to maintain order in society. I love how a policy is the outline for a goal that an institution intends to accomplish. A law is an established procedure or standard that must be followed by members of society.

Policies are rules that are made up by people that work for different companies or organizations and could result in a person getting written up, suspended and possibly losing their job. A law is made and can and will be enforced by a law enforcement officer if a person fails to stop a red light which is against the law and could possibly result in a person receiving a citation.

A company policy cannot override a local, state, or federal law. An example that I think about is the Family and Medical Leave Act (FMLA) when a person needs to have off because of a pregnancy, surgery, adopting or foster care of a child, serious health issues including a spouse, child, or parent. This is so that a person can keep their job, not necessarily the same position, but the company has to allow them to come back and work receiving the same pay. This is to protect the employee. I’ve used FMLA several times when I had surgery and never had a problem with any of my employees, I just had to use my sick and vacation time, or I was off without pay.

In Chicago, Illinois the U.S. Department of Labor has ordered two railroad companies to pay three workers a total of $650,729.14 in back wages and damages for retaliating against them for reporting workplace injuries and safety concerns. The orders resulted from investigations conducted by the Chicago office of the department’s Occupational Safety and Health Administration (OSHA), which were initiated upon receiving complaints from the employees. Railroad employees know that OSHA intends to defend the rights of workers who report injuries and safety concerns. (Dr. David Michaels) “We will use the full force of the law to make sure that workers who are retaliated against for reporting health and safety concerns are made whole.”

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees.
